Project Update for the week of September 25, 2017
Schedule: Construction will not start in September 2017. Once all property rights and permits have been secured the work will go out to bid. Construction will occur considering three (3) work windows.
Washington Department of Fish and Wildlife authorizes work below the Ordinary High Water Mark:
In the marine system: August 1 - February 15
In the freshwater system: June 15 - October 15
Birch Bay Community tourism work window:
Labor Day to Memorial Day
Right-of-Way: Whatcom County is currently negotiating with six (6) property owners that involve ten (10) parcels. Of those ten (10) parcels, six (6) have agreed to price, but are still waiting for their legal counsel approval.
Permits: The outstanding permits are as follows:
Section 106 of NEPA - Cultural
Corps of Engineers - Individual Permit
Shorelines Permit - After Section 106 is complete, schedule shorelines hearing and receive determination & conditions from Hearing Examiner
Design: Plans are at 95% complete; pending finalization of right-of-way and permitting issues.

Project Update for the week of May 1st, 2017 The archaeological test excavations were completed last week. We appreciate your patience during the testing and future needs on Birch Bay Drive.
Update for the week beginning April 3, 2017: Survey Work
Whatcom County Public Works Survey Crew will be performing some survey work during this week related to the design phase of the project. There will be no lane closures associated with the work. Work will occur on the shoulder of Birch Bay Drive and will last approximately 2 days.
The Open Record Public Hearing for the Shoreline Permit has been canceled for Wednesday, December 7, 2016, at 1:40 PM, in the Council Chambers, Whatcom County Courthouse, 311 Grand Avenue, Bellingham, WA.
