The following exemptions are for the
building permit only--all Fire Regulations, Natural Resource Regulations, Zoning and set back requirements apply and must be met for the project.
Per IRC 105.2, exemptions include:
- 1-story detached, nonoccupied accessory structures without basements, used as tool and storage sheds, playhouses, and similar uses, provided that:
- Accessory structures maintain a minimum separation of 10 feet between exterior walls, and a minimum separation of 6 feet between eaves of adjacent buildings on the same property
- Accessory structure meet all applicable setback requirements
- Floor area does not exceed 200 square feet measured outside wall to outside wall
- Maximum eave overhang is 18 inches
- Above ground prefabricated swimming pools:
- Accessory to Group R (residences)
- Less than 24 inches tall
- Less than 5,000 gallons
- Detached decks, sidewalks, and driveways not more than 30 inches above grade and not over any basement or story below
- Fences not over 7 feet high
- Painting, papering, tiling, carpeting, cabinets, counter tops, and similar finish work
- Retaining walls not over 4 feet in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge
- Swings and other playground equipment
- Water tanks supported directly upon grade:
- Capacity does not exceed 5,000 gallons of water
- Ratio of height to diameter or width does not exceed 2 to 1
- Window awnings supported by an exterior wall
- Do not project more than 54 inches from the exterior wall
- Do not require additional support
